Terms of Use

1. Platform Description

mypropey.com is a technology marketplace operated by Mypropey India and Innovexis Consulting LLP. We connect verified landlords with prospective tenants. We are NOT a property manager, real estate broker, escrow agent, or party to any rental agreement. All tenancy decisions are between the tenant and the landlord.

2. User Eligibility

• Users must be 18+ years of age.
• Users must provide accurate KYC information.
• Landlords must be the legal owner or authorized representative of the listed property.
• Tenants must verify their identity via Aadhaar or other government ID.

3. Listing Standards

Landlords are solely responsible for: accuracy of listing photos, videos and property details; legal ownership and right to lease; and compliance with all local rental laws including Karnataka Police Verification requirements.

4. Fee Structure

• Contact Reveal Fee — ₹199 per property (tenant).
• Tenant Subscription — ₹299/month, unlimited reveals (optional).
• Intent Deposit — ₹500 (tenant, fully refundable, adjusted against Match Fee).
• Tenant Match Fee — 25–50% of one month's rent (default 33%), payable at deal confirmation.
• Landlord Match Fee — 50% of one month's rent (NamasteNest: flat ₹2,500 / ₹4,000 / ₹6,000 by tier).
• Verified Host Badge — ₹999/year (optional, landlord).
• Featured Listing — ₹499/month (optional, landlord).

All fees are displayed clearly before any payment is collected. No hidden charges.

5. Contact Reveal & Payment Gate

Contact details (phone, email, exact address) of any party listed on mypropey are revealed ONLY after the applicable platform fee has been successfully collected.

Any user who (a) attempts to bypass the platform fee structure by sharing personal contact information directly, (b) recruits a tenant or landlord off-platform after using mypropey's introduction service, or (c) shares mypropey-sourced contact information with third parties to avoid fees, is in MATERIAL BREACH of these Terms and shall be liable for:

• Immediate suspension or termination of their account.
• Forfeiture of all fees already paid (no refund).
• Recovery of unpaid match fees through legal proceedings.
• Damages equal to 200% of the avoided platform fee, plus legal costs.

6. Match Fee Terms

The Match Fee becomes due upon "Deal Confirmation", defined as any of: tenant pays the match fee on the platform; tenant and landlord exchange full contact details through the platform; or tenant moves into the property within 60 days of any contact reveal on the platform.

Match Fees are payable within 7 days of Deal Confirmation. mypropey may auto-debit the Landlord Match Fee via the registered UPI mandate with 24 hours' notice.

7. Cancellations & Refunds

• Contact Reveal Fee: non-refundable once contact is shared.
• Monthly Subscription: pro-rata refund if cancelled within 24 hours of payment.
• Intent Deposit: 100% refundable if tenant decides not to proceed within 7 days of visit.
• Match Fee: non-refundable once full contact details exchanged.

8. Dispute Resolution

1. Direct negotiation between parties.
2. Mediation facilitated by mypropey customer support within 7 days of dispute.
3. Final — arbitration in Bengaluru under the Arbitration & Conciliation Act, 1996.

9. Limitation of Liability

mypropey's liability is strictly limited to refund of platform fees in case of platform fraud or service failure. We do NOT guarantee property condition, landlord/tenant conduct, or tenancy outcomes. We are NOT liable for any damages arising from the rental relationship.

10. Governing Law

These Terms are governed by the laws of India. Jurisdiction lies with the courts of Bengaluru, Karnataka.
